<p>
This agreement is between CAcert, Inc. ("CAcert"), a non-profit association registered in New South Wales, Australia and a member of the community ("Contributor") including any legal entity, including subsidiaries and affiliates that they represent.
</p>
<p>
Whereas:<br />
</p>
<ul>
<li>CAcert, in the course of delivering certificate authority and related services to the community, maintains and sub-licenses a body of intellectual property (including but not limited to software, source code, agreements and documentation).
</li>
<li>Contributor has made and/or intends to make submissions of source (including patches) and object code, documentation, knowledge, graphics and any other original work of authoriship (including modifications to or derivatives of existing work) ("Contributions") to CAcert.
</li>
</ul>
<p>
Now therefore CAcert and Contributor enter into this agreement, governed by the laws of New South Wales, Australia.
</p>
<ol style="list-style-type: lower-roman;">
<li>
<strong>Contributor (or a third-party licensor) reserves all rights to the Contributions.</strong>
</li>
<li>
<strong>CAcert undertakes to make the work available under an Open Source Initiative Approved License</strong> (such as the GNU General Public License or GNU Free Documentation License).
</li>
<li>Contributor assigns CAcert a perpetual, worldwide, non-exclusive, royalty-free, irrevocable copyright and patent license (where applicable) to reproduce, display, perform, modify, publish and distribute the Contributions.
</li>
<li>Contributor represents that the Contributions are their own original creation (or in the case of third party contributions, that any licensing or patent restrictions are clearly identified), do not violate any third party's copyrights, trademarks, patents, or other intellectual property rights and that they are legally entitled to grant these licenses, including having obtained any necessary permissions from their employer.
</li>
<li>CONTRIBUTIONS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
</li>
</ol>
<p>
Agreement shall be executed by way of digitally signed email to support@cacert.org using an assured CAcert certificate, whereby the Contributor is the subject of the certificate.
